A t\u00f6rv\u00e9ny indokol\u00e1sa \u00e9rtelm\u00e9ben \u201c<em>a beny\u00fajtott szab\u00e1lyoz\u00e1s az\u00e9rt fontos, mert Magyarorsz\u00e1gon a kereskedelem koncentr\u00e1ci\u00f3ja r\u00f6vid id\u0151 alatt jelent\u0151sen n\u0151tt, m\u00e1ra a kiskereskedelmi forgalom 69 %-\u00e1t uralj\u00e1k a nagy \u00e9s k\u00f6zepes v\u00e1llalkoz\u00e1sok, amelyek alig 1 %-\u00e1t k\u00e9pviselik az \u00f6sszes kereskedelmi v\u00e1llalkoz\u00e1snak. A mintegy 99 % mag\u00e1n, mikro- \u00e9s kisv\u00e1llalkoz\u00e1s \u00edgy a forgalomb\u00f3l mind\u00f6ssze 31 %-kal r\u00e9szesedik. E tendencia m\u00e1ra m\u00e1r nehezen visszaford\u00edthat\u00f3, de m\u00e9rs\u00e9kelhet\u0151 lenne a tervezett int\u00e9zked\u00e9ssel.<\/em>\u201d<\/p>\n<p>Els\u0151sorban az ingatlanpiaci r\u00e9sztvev\u0151k tev\u00e9kenys\u00e9g\u00e9t t\u00e1mogat\u00f3 \u00fcgyv\u00e9di irodak\u00e9nt kritikusan tekint\u00fcnk az \u00faj szab\u00e1lyoz\u00e1sra \u00e9s azt diszkriminat\u00edvnak tartjuk. Nemcsak a 300 m2 alatti ter\u00fcleten kereskedelmi tev\u00e9kenys\u00e9get folytat\u00f3k pozit\u00edv diszkrimin\u00e1ci\u00f3ja miatt, hanem a m\u00e1r megval\u00f3sult \u00e9s a m\u00e9g tervezett fejleszt\u00e9sek k\u00f6z\u00f6tti k\u00fcl\u00f6nbs\u00e9gt\u00e9tel miatt. A t\u00f6rv\u00e9ny olyan m\u00f3don avatkozik be a piaci folyamatokba, ami s\u00e9rti a gazdas\u00e1gi alkotm\u00e1nyoss\u00e1got \u00e9s a piaci verseny szabads\u00e1g\u00e1t. R\u00e1ad\u00e1sul nem a kereskedelmi tev\u00e9kenys\u00e9g folyat\u00e1s\u00e1t (m\u0171k\u00f6d\u00e9si enged\u00e9lyek kiad\u00e1s\u00e1t) tiltja, hanem kereskedelmi \u00e9p\u00edtm\u00e9ny <em>l\u00e9tes\u00edt\u00e9s\u00e9t<\/em>.
